Albuquerque Homicide by Vehicle While DWI Sentence: Case Outcomes
These selected New Mexico homicide-by-vehicle-while-DWI reports describe combined judgments, not homicide-only terms. Casino Salazar’s prosecutor announcement gives 18 years in the Department of Corrections followed by three years of probation after a no-contest plea to vehicular homicide and other charges. Bearden’s report gives 22 years in prison plus five years of probation across four pleaded offenses; neither source supplies a separate homicide-count allocation.
Evidence scope: Two named prosecution reports are retained. The prosecutor’s Salazar announcement identifies Montgomery/Morris; KOB’s Bearden incident report identifies San Pedro/Zuni and the fairgrounds. Roswell’s prior DWI arrest is not another Albuquerque case. Independent municipal-point and subsequent-docket review are incomplete. Relevant available passages were read September 28, 2026. Reported sentencing or an appellate affirmance does not establish exhausted appeals. This selected sample is not all Albuquerque cases, an average, a typical result or a prediction.
Observed Outcomes
| Case | Albuquerque offense location | Reported sentence and verification limits | Sentence scope | Sources |
|---|---|---|---|---|
| Casino Salazar | Montgomery and Morris, Albuquerque | 18 years in prison plus 3 years probation; sentencing reported August 2023 after a no-contest plea. | Vehicular homicide and multiple other charges under the no-contest resolution; 18-year reported total is not a separately allocated homicide term. | Sentencing source · Official record |
| John Eugene Bearden Jr. | Crash near San Pedro and Zuni; vehicle taken from Expo New Mexico, Albuquerque | 22 years in prison plus 5 years probation after guilty pleas. | Combined outcome for DWI vehicular homicide, DWI great bodily harm by vehicle, knowingly leaving a crash involving great bodily harm or death, and vehicle theft; no separate leaving-scene or homicide count term supplied. | Sentencing source · Supporting record |
How to Read These Sentences
Both reports describe combined outcomes. The reported prison totals therefore cannot serve as a homicide-only statutory floor or ceiling. Probation is shown separately where reported, and a prior DWI in a different municipality is not counted as an additional Albuquerque case.
In New Mexico reporting, the imposed sentence, suspended portion, prison time and probation are not interchangeable. The table preserves the distinctions actually supplied by each source instead of assuming that every announced year will be served in prison.
Scope and Limits
These are reported judgments, not a statutory sentencing range. The applicable law, conviction, enhancements and count structure must be checked separately for an individual case. No average sentence is calculated, and an aggregate outcome is never presented as an isolated target-offense sentence.
Offense-location passages, not court or prosecutor addresses alone, support the reported Albuquerque connection. This review has not independently certified every municipal point or later judgment. State and federal outcomes remain separate. An earlier incident report supports location/background, not the later conviction label or sentence.
